According to Deputy Minister of Justice Nguyen Thanh Ngoc, Resolution 68-NQ\/TW of the Politburo on private economic development has clearly shown the important role of this type of economy in the current period, as an important driving force of the economy. Both Resolution 68-NQ\/TW and Resolution 66-NQ\/TW of the Politburo set out the task of reviewing and perfecting institutions. <\/span><\/p>\n

Resolution No. 66-NQ\/TW on innovation in law-making and enforcement to meet the requirements of national development in the new era of the Politburo also clearly states the development and improvement of laws on the organization and operation of judicial agencies and judicial support in accordance with the goals and orientations of judicial reform. Strongly promote the development of the legal service system, legal support, legal aid, and registration of security measures to make it easier for people and businesses to access the law and manage legal risks. Prioritize legal support resources for the private economic sector. <\/span><\/p>\n

With the clear viewpoint and goals of the Politburo, the Ministry of Justice is currently working with ministries and branches to identify institutional bottlenecks, creating conditions for the private economy to develop.<\/span><\/p>\n

According to experts, institutional and law enforcement bottlenecks hinder the development of the private economy, namely legal documents that have not completely overcome the mindset of “if you can’t manage, then ban” and the “ask-give” mechanism. The legalization of the Party and State’s viewpoints is still slow, administrative procedures are slow, some sub-law documents are not synchronous, and the policy mechanism for businesses to access incentives is unclear. Policy implementation is also slow and lacks synchronization, lacking coordination between ministries, branches, and localities… <\/span><\/p>\n

From the business perspective, Mr. Nguyen Duy Lam, Chairman of the Business Law Association, pointed out two major bottlenecks at present: the enforcement staff and inadequate institutions. He said that, in addition to continuing to simplify administrative procedures, it is necessary to focus on training, improving capacity and public ethics to limit the situation of “hindrance” for businesses. This is a prerequisite for the legal framework to be put into practice effectively. <\/span><\/p>\n

At the same time, it is necessary to promote policy communication, helping businesses understand and apply regulations correctly, avoiding legal risks. Support policies must also be expanded, especially in transforming business models, accessing premises, capital and taxes. Synchronous coordination between ministries, localities and professional associations will create an effective “support ecosystem”, replacing fragmented and unstable policies. <\/span><\/p>\n

With nearly one million businesses in operation, of which 98% are small and medium-sized enterprises, Associate Professor, Dr. Dinh Dung Sy, a legal expert, emphasized that private economic development policies must focus on the right subjects. What this sector needs most now is not only simple procedures, low costs, and a mechanism to guarantee business rights, but also a legal corridor to encourage innovation and technology application to improve competitiveness. <\/span><\/p>\n

According to Associate Professor, Dr. Dinh Dung Sy, an urgent requirement is to review and amend laws that directly impact businesses such as the Enterprise Law, Investment Law, Land Law, Construction Law and the tax law system. <\/span><\/p>\n

In addition to removing bottlenecks in access to land, credit and investment opportunities, these reforms need to incorporate policies to support innovation, promote technology startups and create conditions for businesses to experiment with new business models.<\/span><\/p>\n

Chairman of the Vietnam Bar Federation Do Ngoc Thinh said that the legal regulations for small and medium-sized enterprises need to be specific and easy to access; at the same time, it is necessary to build laws with a small, narrow, and short scope to encourage this type of enterprise to follow.<\/span><\/p>\n

It can be seen that strengthening law enforcement and making the administrative apparatus transparent is one of the decisive factors to create a fair and stable business environment for the private sector.<\/span><\/p>\n
